Dakshinbharath Technologies Private Limited ("DAKSHINPAY") is concerned about the privacy of its users ("User/You") accessing its website at www.Dakshinpay.com or accessing the Service through Dakshinpay mobile application or our APIs integrated with our Merchants and/or Financial Partners ("Website") and has provided this privacy policy ("Policy") to familiarise You with the manner in which the technology platform and program provided by Dakshinpay enabling the Users to carry out checkout transaction processing at merchant shop, website and mobile based application (“Service”) and uses and discloses Your information collected for the same through the Website. Capitalized terms not specifically defined herein shall have the meaning given to them under the Terms and Conditions available at www.Dakshinpay.com/terms-and-conditions ("User Terms").

    Scope of Policy:

  • When You register/signup (including signup through third party sign-in services such as Facebook and LinkedIn) with the Website or use the Website or the Service available thereon or link your social media accounts with the Service or your information maintained with our Financial Partners, Dakshinpay may seek and collect certain personal and non-personal information (including information made available through third party sign-in services or your social media accounts), classified as mandatory or voluntary (collectively "Information"). Accordingly, whenever You use, register or signup with the Website or Service, You consent to the collection, use, and disclosure of the Information in accordance with this Policy

    • Collection and Use of Personal Information:

  •   Personal information is data that can be used to uniquely identify or contact a single person. "Personal Information" for the purposes of this Policy shall include, but not be limited to, information regarding Your name, address, telephone number, date of birth, gender, e-mail address, location, any data available on your mobile phone or other devices, proof of identity issued by any governmental authority etc.
  •   The Website may collect Personal Information from You in various ways, including but not limited to, Personal Information provided by You. This includes information provided by You when you use the Service and/or when You register with the Website, create a User Identity also known as User Id, provide information in Your account, search for specific services or content, communicate with Dakshinpay customer service by phone, email or otherwise, participate in discussion boards or other community features, provide reviews for the Service available on the Website, or to create an account with Dakshinpay.
  •   As indicated above, some of the Information that Dakshinpay may ask You to provide will be identified as mandatory and some as voluntary. If You do not provide the mandatory Information with respect to the Service, You will not be able to avail of the Service provided by Dakshinpay. Similarly, if You wish to delete Your Information that is mandatory, You will no longer be eligible to avail the Service offered by Dakshinpay or the Website.
  •   Dakshinpay collects Personal Information that Dakshinpay believes to be relevant and which is required to understand You and your interests and for the purpose of promoting the Website and the Service. Dakshinpay collects your Personal Information in order to record, support and facilitate your participation in the Service, track your preferences, to provide You with a customized Website experience, to notify You of any updated information and new activities and other related functions offered by Dakshinpay, keep You informed about latest content available on the Website, special offers, and other products and Service of Dakshinpay, to assist You with customer service or technical support issues, to follow up with You after Your visit, to otherwise support Your relationship with Dakshinpay or to prevent fraud and unlawful use.

  •   Dakshinpay will use reasonable safeguards to preserve the integrity and security of Your information against loss, theft, unauthorised access, disclosure, reproduction, use or amendment. To achieve the same, Dakshinpay will use reasonable security practices and procedures as mandated under applicable laws for the protection of your information. Information You provide to us may be stored on our secure servers located within or outside India.
  •   You understand and accept that there’s no guarantee that data transmission over the Internet will be completely secure and that any information that you transmit to us is at your own risk. Dakshinpay assumes no liability for any disclosure of information due to errors in transmission, unauthorized third party access to our Website and data bases or other acts of third parties, or acts or omissions beyond our reasonable control and you shall not be entitled to hold the Dakshinpay responsible for any breach of security.
  •   We will hold the information shared by you in the manner described above for as long as we reasonably require for fulfilling the purpose for which we collected such information. This includes for any regulatory, archival purposes, or to protect/defend the Company from any legal claims by anyone.

    • Disclosure of Personal Information

  •   Dakshinpay will keep Your Personal Information confidential to the maximum possible extent. Dakshinpay limits the disclosure of Personal Information to Dakshinpay’s employees, independent contractors, affiliates, consultants, business associates, service providers and distributors of Dakshinpay’s Service, on a need-to-know basis, and only if the disclosure will enable that entity to provide Dakshinpay with business, professional, or technical support or to fulfil Your request. Dakshinpay shares Personal Information only for the purposes stated in Clause 2 above and only for to the entities described below.
  •   Your Personal Information may be disclosed:
    • a. to Dakshinpay’s business affiliates and Financial Partners where certain content or Service are jointly offered by Dakshinpay and its business affiliates and Financial Partners; or
    • b. to Dakshinpay’s third party services providers who provide services such as contact information verification, payment processing, order fulfilment, customer service, website hosting, data analysis, marketing assistance, infrastructure provision, IT services, auditing services and other similar services to enable them to provide the services; or
    • c. in case of business transfers such as a merger, acquisition or any form of sale of some or all of Dakshinpayl’s assets, Your Personal Information shall be transferred to the other entity as a business asset. Dakshinpay will ensure the confidentiality of any Personal Information involved in such transactions and provide You with a notice before Your Personal Information is transferred and becomes subject to a different privacy policy; or
    • d. as Dakshinpay may believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with any legal processes; (iii) to respond to requests from public and government authorities; (iv) to enforce Dakshinpay’s Terms of Use; (v) to protect Dakshinpay’s operations or those of any of Dakshinpayb’s affiliates; (vi) to protect Dakshinpay’s rights, privacy, safety or property, and/or that of Dakshinpay’s affiliates, You or others; and (vii) to allow vto pursue available remedies or limit the damages that Dakshinpay may sustain. This includes disclosing Your Personal Information to other companies and organizations for fraud protection and credit risk reduction; or

  •   The above does not include selling, renting, sharing or otherwise disclosing Personal Information for commercial purposes in violation of the commitments set forth in this Policy.

    • Collection and Use of Non-Personal Information

  •   Non-personal information is any information that does not reveal Your specific identity, such as, browser information, Internet protocol (IP) address, operating system, and platform, information collected through cookies, pixel tags and other technologies, demographic information, time zone setting, etc. ("Non-Personal Information").

    • Security

  •   Notwithstanding anything contained in this Policy or elsewhere, Dakshinpay shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below). A "Force Majeure Event" shall mean any event that is beyond the reasonable control of Dakshinpay and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, etc.

    • Access to Information

  •   When You use the Website and the Service provided by Dakshinpay on the Website, Dakshinpay makes good faith efforts to provide You with access to Your Information and other relevant data, either to correct this data if it is inaccurate, or to delete such data at Your request, if it is not otherwise required to be retained by law or for legitimate business purposes.
  •   Dakshinpay gives You access to a broad range of Information about Your account and Your interactions with Dakshinpay for the limited purpose of viewing and, in certain cases, updating that information. Such information includes, up-to-date information regarding recent Service accessed by You; Personal Information, payment settings (including credit card information); e-mail notification settings (including Alerts, Recommended for You, and newsletters); utility bill payment details; recommendations (including recent content view history, and favourites); shopping lists; and Your profile (including Your Service reviews, requests, and recommendations, guides, etc.)

    • User Discretion
